AGREEMENT REGARDING THE RIGHT TO USE THE SERVICE FOR MAKING VOLUNTARY DONATIONS

Please read all the provisions of this Agreement carefully and ensure that you understand them. If you refuse to accept the terms of the Agreement, you will not be able to support the Charity Organization "Charity Fund" Pirogov First Volunteer Mobile Hospital" (PDMSh) using the service for regular automatic money transfers (donations). The Charity Organization "Charity Fund" Pirogov First Volunteer Mobile Hospital" (PDMSh) reserves the right to change the provisions of this Agreement in the manner provided for in this Agreement.

This Agreement is concluded between the Charity Organization "Charity Fund" Pirogov First Volunteer Mobile Hospital" (PDMSh) (hereinafter referred to as the "Fund"), EDRPOU code 39932886, and the user of the Internet platform owned by PDMH (https://pdmsh.ua/en), who plans to use the Support section of the Fund's Internet platform (Site) as a User (hereinafter referred to as the "User"). The terms used in this Agreement are used in the meanings set forth in this Agreement, in the Public Offer Agreement, which is posted at the unique address on the Internet: https://pdmsh.ua/en/public-offer, and in the absence of terms in these Agreements – according to the current legislation of Ukraine.

SUBJECT OF THE AGREEMENT

1.1 The Fund grants the User a non-exclusive right to use the service, namely, to make a voluntary donation (charitable contribution) in favor of PDMSh on a regular basis by subscribing to regular automatic payments, through transfers from the User's card using the monthly subscription form on the Site page - https://pdmsh.ua/en/donate.

COST AND TERMS OF USE OF THE SUBSCRIPTION 

2.1. A regular charitable donation by the User in favor of PDMSh is called a subscription under the Site's terms (hereinafter referred to as the "Subscription"). 

2.2. The cost of the Subscription is determined by the User at their discretion and can be any amount payable by any available payment methods at the time of subscription on the Site page: https://pdmsh.ua/en/donate. 

2.3. The Subscription is activated upon the Fund receiving information about the donation made under the terms of the Subscription in the amount chosen by the User in accordance with clause 2.2 of this Agreement. 

2.4. The charitable donation under the terms of the Subscription is paid by the User to the Fund in the manner and on the terms specified below: 

     2.4.1. The charitable donation under the terms of the Subscription is made by the User, subject to the financial contribution made by the User in the monthly Subscription form on the Site page: https://pdmsh.ua/en/donate. 

     2.4.2. By making a contribution using the Subscription, the User confirms that they are informed and agree that: 

• Automatic withdrawal of funds using the Subscription occurs systematically, usually on the day preceding the date of the previous contribution under the terms of the Subscription. If the attempt to withdraw funds from the User's account at the time of automatic withdrawal is unsuccessful, the automatic withdrawal may be repeated until the funds are successfully withdrawn within 5 calendar days from one of the saved bank cards specified by the User when entering data in the monthly Subscription form on the Site page: https://pdmsh.ua/en/donate. If the withdrawal is unsuccessful within 5 calendar days, automatic withdrawal attempts cease after 5 calendar days from the date of the previous Subscription's end. 
• The User may cancel the automatic withdrawal under the Subscription at any time. To do this, the User must use the functionality of the page at the link https://pdmsh.ua/en/donate-unsubscribe. The non-exclusive right to use the service under the Subscription for such a User is suspended from the day following the last day of withdrawal, and automatic withdrawal of funds from the User's bank card for subsequent periods is not performed. The User may renew their right to use the service under the Subscription by re-entering data in the monthly Subscription form on the Site page: https://pdmsh.ua/en/donate. 

     2.4.3. The contribution is made by any available method at the time of the withdrawal of funds under the Subscription. 

2.5. By entering the bank card details for paying for the Subscription, the User gives full and unconditional consent to the Fund to store the card token (unique digital identifier) in an encrypted form, through which the User can subsequently pay for the Subscription on the Platform without entering the bank card details. 

     2.5.1. The cost of the Subscription is determined solely by the User and cannot be changed by anyone other than the User. 

2.6. The Subscription is paid non-cash using the payment system (https://tranzzo.com/uk-ua) LLC "EUROPEAN PAYMENT SYSTEM" EDRPOU 39269220, Ukraine, Kyiv, 03124, Ivan Lepse Boulevard, building 4.

DURATION OF THE SUBSCRIPTION 

3.1. The Subscription period is 1 (one) month starting from the date of the first contribution with automatic renewal every month until the Subscription is terminated in accordance with clause 2.4.2 of this Agreement. 

3.2. By using the Subscription, the User must comply with the terms of the Public Offer Agreement and this Agreement. The Fund has the right to change the terms of the Public Offer Agreement unilaterally.

DURATION OF THE AGREEMENT 

4.1. This Agreement takes effect from the moment the first payment is made under the Subscription and is valid for the entire period until it is canceled in the event of termination of this Agreement. 

4.2. The User may prematurely terminate this Agreement and cancel the Subscription.

CHANGES TO THE AGREEMENT 

5.1. The Fund reserves the right to review and amend the terms of the Agreement. 

5.2. Changes to the Agreement take effect from the moment they are published on the Platform's Web page at: https://pdmsh.ua/en/reсurrent-public-offer. The User is obliged to familiarize themselves with the changes to the Agreement independently at the aforementioned address.

FINAL PROVISIONS 

6.1. All disputes arising between the Parties regarding the conclusion, execution, and termination of the Agreement are submitted to the court for consideration in accordance with the legislation of Ukraine. The material and procedural law of Ukraine applies to the legal relations of the Parties under the Agreement. 

6.2. Evidence of full and unconditional acceptance (acceptance) of the terms of the Agreement, as well as the date of conclusion of the Agreement, is the date of the payment under the terms of the Subscription. The Agreement concluded by accepting the public offer has the legal force of a contract sealed with the signatures of the parties, and the parties bear the rights and obligations stipulated by it. 

6.3. By concluding the Agreement, the User confirms that they unconditionally accept all the terms of the Agreement without any reservations. 

6.4. If any provision of the Agreement is declared invalid, all other provisions remain unchanged and valid.
